These terms tell you who we are, how we provide our products and services to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. Please read them before placing an order. By placing an order you agree to them.
2. Consumers and businesses
Some of these terms apply only if you are a consumer (buying wholly or mainly for personal use) and some only if you are a business. Where that is the case we say so. Nothing in these terms limits your statutory rights as a consumer.
3. Our products
We supply e-commerce software, hosted subscription services (SaaS), business email services and related setup, training and support. Descriptions, screenshots and demonstrations are provided in good faith, but minor differences may exist between what is shown and what is delivered.
4. Placing an order
Your order is an offer to buy. A contract comes into existence only when we send you an order confirmation. If we cannot accept your order we will tell you and will not charge you.
5. Price and payment
- Prices are shown on the product page. We take reasonable care to ensure they are correct; if we find an obvious pricing error before accepting your order, we may decline it.
- Where VAT applies it is stated at checkout. If the VAT rate changes between your order date and the date we supply, we adjust the VAT you pay unless you have already paid in full.
- Subscriptions are billed in advance for each billing period and renew automatically until cancelled.
- If you are a business and a payment is overdue, we may charge interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Licence and intellectual property
All intellectual property in our software, documentation, designs and site content belongs to us or our licensors. On payment in full we grant you a non-exclusive, non-transferable licence to use the product you have bought, for your own business, for as long as the contract lasts. You may not resell, sublicense, redistribute or publish the software, or remove any notice of ownership, unless the licence you bought says otherwise in writing.
7. Your responsibilities
You are responsible for the accuracy of the information you give us, for keeping your account credentials secure, for the lawfulness of the content you publish through our services, and for holding your own backups of any data you consider important. Your use of the service must comply with our Acceptable Use Policy.
8. Service availability and support
We aim to keep hosted services available at all times, but we may suspend them for maintenance, security or technical reasons. Where we can, we give reasonable notice. Support is provided during the working hours published on our contact page.
9. Cancellation and refunds
Your cancellation and refund rights are set out in our Refunds and Cancellations policy, which forms part of these terms.
10. If there is a problem
Please contact us at hello@weblibi.com. If you are a consumer, we are under a legal duty to supply products and digital content that conform to this contract. Nothing in these terms affects your rights under the Consumer Rights Act 2015.
11. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any breach of your statutory rights as a consumer.
If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, nor for business losses.
If you are a business: we exclude all implied warranties to the fullest extent permitted by law. We are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings or any indirect or consequential loss. Our total liability arising under or in connection with the contract is limited to the total sums you paid us in the twelve months before the claim arose.
12. Ending the contract
You may cancel a subscription at any time with effect from the end of the current billing period. We may end the contract if you fail to pay, if you materially breach these terms, or if you do not provide information we reasonably need in order to supply the service.
13. Changes to these terms
We may change these terms. If a change materially affects your rights we will give you reasonable notice, and you may end the contract before the change takes effect.
14. Governing law and jurisdiction
These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country you live in.
